Qualification for the EB2 National Interest application goes through two phases:

Advanced degree:
Bachelor's degree or equivalent in your area of specialization and 5 years of proven experience in your area of expertise (for a bachelor's degree) or 10 years (for a technician);
- Or a master's degree or equivalent in the US;

- Academic record;
- License or certification to practice the profession;
- Letter of recommendation;

- Other comparable evidence of eligibility.

Steps of the EB2-NIW claim

1st Step: I-140 Petition
In the first step of the process, we prepare and file the I-140 petition along with all the necessary documentation to prove that the alien has an advanced degree or exceptional ability and that his or her knowledge and experience is of national interest to the United States.

After the approval of the I-140 petition by the USCIS, we proceed to the next stage of the process, which consists of applying for American residency (Green Card). Foreigners can apply to obtain a Green Card in their home country or in the United States.
Status Adjustment
If the applicant is in the United States and has a valid visa, he/she will apply for the Green Card through the Adjustment of Status (Form I-485) with the USCIS. During Adjustment of Status processing, the applicant must remain in the US until travel authorization is received. This phase starts when the process priority date is "current". The priority date is the date the USCIS receives the I-140 petition.
Consular Process 
If the EB-2 National Interest Waiver visa applicant is located outside of the United States, the approved I-140 petition will be sent to the National Visa Center (NVC), which will process the application and send all documentation to the U.S. Consulate in the country in where the foreigner resides. Then, the applicant will go through an interview and, if approved, will receive the immigrant visa.

What does the EB2-NIW assessment curriculum need to have?
