November Visa Bulletin: Status Adjustment changes for December

The USCIS announcement states that Adjustment of Status applications will be frozen on December 1, 2022, with no return date set. Understand!

O latest “Visa Bulletin” report sent out by USCIS – United States Citizenship and Immigration Services – on November 16, 2022, provides important information about Adjustment of Status. Adjustment of status occurs when an individual is in US territory on a non-immigrant visa and wishes, after some time, to change to an immigrant visa, i.e. apply for a Green Card. This happens, for example, when a person arrived in the United States on a tourist visa and, after some time, decided to stay in the country by applying for the EB2 NIW. The USCIS announcement states that the possibility of this adjustment will be frozen on December 1, 2022, with no return date set. This has already happened in other years. In 2019, for example, this possibility was revoked for two consecutive months (August and September). The D4U Immigration team is already taking the necessary steps and will carry out a task force so that clients who are facing a delicate deadline can have their case filed for adjustment of status by November 30. At the moment all immigration offices are dealing with this new demand from USCIS, but we at D4U will proactively contact clients who are in this situation and help them through this delicate period. Please note that this is only relevant for those who are still NOT applied for the EB2-NIW visa. Only those who are in the US and will be applying in the next few months should be concerned.
