The process of obtaining a driver’s license for visa holders is governed by state rules, not by one national DMV system. California and Florida have different document lists, procedures and validity rules.
California vs. Florida driver’s license: what changes?
Both states require applicants to establish their identity, residence and authorized presence in the United States. However, the agencies, acceptable documents and local appointment procedures differ.
California applications are handled by the California Department of Motor Vehicles. Florida licenses are issued through the Florida Department of Highway Safety and Motor Vehicles and, in many locations, county tax collector offices.
Applicants should use the checklist for their state and immigration category. An H-1B professional, F-1 student, L-1 transferee or dependent visa holder may not present the same immigration documents.
Documents commonly required in California
A California applicant will generally need identity and lawful-presence evidence, a Social Security Number when eligible and proof of California residence.
For a REAL ID, the California DMV currently requires two different documents showing the applicant’s California residential address. Acceptable examples may include a lease, utility or mobile-phone bill, bank statement or vehicle registration.
Noncitizens may use eligible documents such as an unexpired foreign passport with a valid visa and approved I-94, a Green Card or an unexpired Employment Authorization Document. The exact combination should be confirmed through the California DMV checklist.
Applicants who do not qualify for a REAL ID may have other licensing options under California law. These alternatives should not be confused with a federally compliant identification document.
Documents commonly required in Florida
Florida applicants must generally present original documents establishing identity and legal presence, proof of Social Security Number when applicable and two documents proving a Florida residential address.
A nonimmigrant may need to present a passport, visa, I-94, I-797 approval notice, I-20, DS-2019 or EAD, depending on the person’s category.
Because many Florida services are handled locally, appointment availability and additional service fees may vary by county. The applicant should verify the rules of the specific tax collector office before attending.

California and Florida do not offer a general reciprocal conversion that allows a Brazilian driver to exchange a CNH without completing the required state process. A valid foreign license may help demonstrate driving experience, but it does not automatically eliminate testing requirements.
REAL ID and domestic flights
REAL ID enforcement began at TSA checkpoints on May 7, 2025. A traveler who does not have a REAL ID-compliant driver’s license can still use another TSA-accepted document, such as a valid passport.
Therefore, a REAL ID is not the only way a visa holder can board a domestic flight. It is an optional form of federally accepted identification that many residents choose for convenience.
An ordinary noncompliant license may still authorize driving when valid, but it cannot be used for federal identification purposes covered by REAL ID enforcement.
How immigration status affects validity
A state agency may verify lawful presence through the federal SAVE system. If the initial verification is inconclusive, the application may be placed under additional review rather than approved immediately.
The validity of a limited-term license may be connected to the immigration documentation verified by the state. However, applicants should not assume that both states always use the visa stamp, I-94 or EAD expiration date in exactly the same way.
A pending extension also does not guarantee immediate renewal. Some applicants can provide an I-797 receipt or other evidence, but the agency may need additional SAVE verification before deciding whether it can issue or extend the license.
Common application mistakes
The first mistake is bringing only one proof of residence. Both California REAL ID applications and Florida applications generally require two acceptable documents displaying the correct residential address.
Another mistake is relying only on the visa stamp. A visa allows a person to request entry at a port of entry; it does not necessarily establish the person’s current period of authorized stay. The I-94, EAD or approval notice may be more relevant to the licensing agency.
Applicants also confuse the Social Security Number with the physical Social Security card. Requirements vary, and people who are not eligible for an SSN should follow the state’s instructions rather than automatically obtain an SSA denial letter that may not be required.
A foreign driver’s license and an International Driving Permit do not create an unlimited right to drive after establishing state residency. California and Florida impose deadlines on new residents, and insurance companies may have separate requirements.
Finally, immigration extensions do not automatically update the driver’s license. The cardholder must monitor the printed expiration date and complete the appropriate renewal process.
