1. Introduction

These Terms of Use (“Terms”) are a legally binding agreement between you (“User”, “you” or “your”) and D4U USA CONSULTING LLC (“Company”, “we”, “us” or “our”), a company based in the State of Florida, United States. These Terms govern your access and use of our mobile application (“App”), which offers auxiliary immigration services, such as status checks, notifications, document upload/storage, and related tools. When applicable, the App integrates USCIS APIs. The App is intended for users over 18 years of age.

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App. Your use is also subject to the Privacy Policy (https://d4uimmigration.com/en/privacy-policy), which explains how we collect, use, share, retain, and delete personal data.

No government affiliation/No legal advice. We are not a government agency nor are we affiliated with or endorsed by USCIS, the U.S. Department of State, or any public agency. Official forms are available for free on government websites. We are not a law firm and do not provide legal advice; using the App does not create an attorney-client relationship. For legal advice, seek a licensed attorney. USCIS warns against scams and unauthorized practice of immigration law services (UPIL); only attorneys or DOJ-recognized representatives can provide legal advice on immigration.

2. Description of Services

Permitted Use and Scope. The Application is a read-only client for official case status information through the USCIS Case Status API. It does not submit forms, alter records, or perform actions on USCIS systems. Access is limited to the data subject (account owner) or a duly authorized representative with explicit, informed, and optional consent. We do not use data scraping or non-public endpoints; we only access USCIS-approved APIs with valid credentials, in compliance with Torch/Developer Portal policies, sandbox/production requirements, and applicable rate limits.

The Application offers auxiliary tools to assist with U.S. immigration processes, including:

  • Case status verification (through USCIS APIs, when applicable).
  • Notifications/alerts about case updates (based exclusively on official API data).
  • Document upload and access (only in Application/tenant storage; no submission to USCIS systems).
  • User action history and personal case organization (client-side metadata only; read-only in relation to USCIS records).
  • Secure authentication (password and optional facial biometrics at the device level; the Application does not collect or store biometric templates; the device’s operating system returns only an approval/rejection signal).
  • In-app profile and case data management (for notifications and organization only; does not modify USCIS records).

We strive to present third-party information exactly as provided by the source. However, we do not control the availability, accuracy, timeliness, or completeness of government systems or data; the use of this data remains subject to USCIS website and platform policies, including rate limits and service availability. Always verify official case information on the uscis.gov website.

3. Compliance with USCIS APIs

When the App uses USCIS APIs (e.g., Case Status API), we follow the requirements of the USCIS Developer Portal, including the Production Access process and the Affidavit. This includes, among others:

  1. (i) readability and accessibility (e.g., WCAG contrast ≥4.5:1, font ≥14px, avoiding long paragraphs);
  2. (ii) data deletion process and timeline;
  3. (iii) transparency about data categories/use/sharing and no data selling;
  4. (iv) active user consent for sharing with third parties; and
  5. (v) CCPA compliance when applicable. We commit to reflecting these requirements in these Terms/Privacy Policy.

USCIS maintains a public developer platform (“Torch”) and an API catalog (including Case Status API). Access/use is subject to USCIS terms and onboarding.

4. Accounts & Authentication

To use certain features, create an account with true, current, and complete information and keep it up to date. You are responsible for all activities on your account and for protecting your credentials. Promptly notify us of any unauthorized use.

Biometrics. If you enable facial/fingerprint recognition, it is provided by your device’s operating system. We do not receive or store biometric templates; the device only returns a success/failure signal. Please refer to our Privacy Policy.

5. User Obligations & Acceptable Use

You agree to use the App lawfully and not to:

  • Submit false or misleading information to public agencies via the App;
  • Impersonate third parties or interfere with the App’s operation;
  • Send malware or attempt to test vulnerabilities;
  • Violate intellectual property/privacy rights;
  • Use the App for commercial purposes without written consent.

You grant us a non-exclusive, royalty-free license to process the content you submit solely for providing the App’s services.

6. Intellectual Property

All App content belongs to us or licensors and is protected by IP laws. We grant you a limited, personal, and non-transferable license for non-commercial use. Reproduction, distribution, modification, or creation of derivative works without written authorization is prohibited.

7. Privacy, Data Practices & Deletion

Our Privacy Policy (https://d4uimmigration.com/en/privacy-policy) describes collection/use/sharing, retention periods, user choices, and security. In line with the USCIS Developer Portal, we do not sell user data and obtain active consent for any third-party sharing. We offer a clear method to delete your data and inform you how long deletion takes after a verified request (target of up to 30 days, subject to legal obligations). We provide plain language summaries when policies change and collect active consent for material changes.

8. Disclaimers

THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT). WE DO NOT PROVIDE LEGAL ADVICE AND USE OF THE APP DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP. DISPLAYED GOVERNMENT DATA MAY BE CHANGED, DELAYED, OR UNAVAILABLE; ALWAYS CONSULT OFFICIAL SOURCES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA LOSS), EVEN IF ADVISED. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold the Company harmless from claims, losses, liabilities, and expenses (including attorney fees) arising from your use of the App, violation of these Terms, or infringement of third-party rights.

11. Unauthorized Practice of Law (Florida)

In Florida, unauthorized practice of law (UPL) is prohibited and may constitute a third-degree felony (Fla. Stat. § 454.23). The App does not provide legal advice and should not be used for such purpose. For legal questions, seek a licensed attorney.

12. Third-Party Services/Links

The App may contain links/integrations with third-party services (e.g., USCIS websites/APIs). These services are governed by their own terms/policies; we are not responsible for their content or practices. Use of the USCIS website remains subject to USCIS website policies.

13. Suspension & Termination

We may suspend or terminate access to the App at any time, with or without cause (including violation of these Terms). Upon termination, your right to use ceases. You may request data export/deletion as per the Privacy Policy.

14. Applicable Law; Venue; Language

These Terms are governed by the laws of the State of Florida (without regard to conflict of law rules) and U.S. federal law. Exclusive jurisdiction is in the state and federal courts located in Palm Beach County, Florida. English prevails: in case of conflict, this English version prevails over translations.

15. Changes

We may update these Terms and will notify you in the App or by email. Continued use after changes take effect constitutes acceptance.
