EAD Renewal Timeline: How to Avoid a Work Authorization Gap

An EAD renewal timeline must be planned according to the eligibility category printed on the Employment Authorization Document. A pending Form I-765 does not always allow the applicant to continue

An EAD renewal timeline must be planned according to the eligibility category printed on the Employment Authorization Document. A pending Form I-765 does not always allow the applicant to continue working after the current card expires.

This distinction became even more important after the government ended the broad automatic-extension policy for renewal applications filed on or after October 30, 2025. Applicants should no longer assume that a timely renewal automatically provides up to 540 additional days of employment authorization.

How EAD Renewal Works

Form I-765 is used to request an initial Employment Authorization Document or renew an existing one. The filing window, required evidence, fee and eligibility for continued employment depend on the applicant’s EAD category.

USCIS generally recommends filing an eligible renewal as early as 180 days before the card expires. Filing early does not guarantee approval before expiration, but it provides more time to address a rejected submission or a request for additional evidence.

For renewal applications filed on or after October 30, 2025, the previous general automatic extension of up to 540 days is no longer available. Certain applicants who filed before that date may remain covered under the earlier transitional rules.

Category-specific extensions and separate government notices may still apply. Applicants must therefore verify the rule governing their exact category instead of relying on general information about EAD renewals.

General Renewal vs. STEM OPT Extension

The rules for STEM OPT are different from the former automatic-extension system applicable to several other categories.

An eligible F-1 student who timely files Form I-765 for a 24-month STEM OPT extension may receive an automatic extension of employment authorization for up to 180 days while the application is pending. The extension ends when the application is adjudicated or the 180-day period expires.

Regular post-completion OPT is not renewed as a standard EAD renewal. Students approaching the end of OPT must determine whether they qualify for STEM OPT, cap-gap protection, another status or a different form of employment authorization.

SituationPossible continued work authorization
General EAD renewal filed on or after October 30, 2025No broad automatic extension
Qualifying renewal filed before October 30, 2025May retain transitional extension protection
Timely STEM OPT extension applicationUp to 180 days under the STEM OPT rule
TPS or another category covered by a specific noticeDepends on the applicable government notice
Pending renewal with no extension ruleWork generally stops when the current authorization expires

H-4 and L-2 Spouses

An H-4 spouse generally needs an approved EAD before working and should not assume that a pending renewal permits continued employment.

Certain L-2 spouses may be employment-authorized incident to status when their Form I-94 contains the appropriate L-2S designation. In those cases, the I-94—not a standalone EAD—may establish work authorization.

Because dependent categories have different rules, applicants should review the I-94, EAD category and underlying status together before filing another Form I-765.

Documents to Prepare

A renewal package may require:

  • the current or most recent EAD;
  • a passport-style photograph;
  • identification documents;
  • the most recent Form I-94;
  • evidence of the underlying status or pending application;
  • previous approval or receipt notices;
  • the correct filing fee or a valid exemption;
  • a properly completed current edition of Form I-765.

USCIS began accepting a newer edition of Form I-765 in September 2026. Using an outdated edition after the applicable transition date can result in rejection.

Fees also vary by category and filing circumstances. Applicants should use the current USCIS fee schedule or official fee calculator rather than relying on an old universal amount.

Common Renewal Mistakes

The first mistake is assuming that a receipt notice automatically extends employment authorization. A receipt proves that USCIS received the application, but it does not independently authorize employment.

The second is filing under the wrong eligibility code. The category on the current card should be compared with the underlying status and the current Form I-765 instructions.

The third is waiting until the final weeks before expiration. Even when no automatic extension is available, filing at the beginning of the permitted window creates more time for USCIS processing.

The fourth is failing to involve the employer’s I-9 team. Human resources should receive updated documentation early enough to determine whether reverification is required.

The fifth is confusing the EAD with a travel document. A valid EAD does not replace a passport, visa or Advance Parole, and a pending renewal does not independently authorize international travel.

What Happens When the EAD Expires?

When no category-specific extension applies, the employee must generally stop working on the EAD expiration date. Continuing to work without authorization can affect both employment compliance and future immigration matters.

The employer may place the worker on unpaid leave if company policy permits, but it cannot continue employing the person in violation of Form I-9 requirements.

An expedite request may be considered in limited circumstances, but approval is discretionary. Approaching expiration or experiencing ordinary financial inconvenience does not automatically satisfy the expedite criteria.

Estimated Timeline and Costs

Processing times differ by category and workload. Applicants should use the official USCIS processing-time tool for the appropriate form and filing location.

The Form I-765 fee has changed in recent years and may differ for initial applications, renewals and humanitarian categories. Some filings are fee-exempt, while others may qualify for a fee waiver.

The safest approach is to confirm the current fee, form edition and mailing address immediately before submission. These details can change during the months between planning and filing.

EAD Renewal Checklist

  1. Check the category printed on the current EAD.
  2. Confirm whether the category can be renewed.
  3. Identify the earliest permitted filing date.
  4. Review whether a category-specific extension applies.
  5. Use the current edition of Form I-765.
  6. Confirm the filing fee and submission method.
  7. Save the receipt and complete application.
  8. Notify the employer’s I-9 or compliance team.
  9. Stop working at expiration if no extension applies.

Frequently Asked Questions

How early should I file an EAD renewal?

Many categories allow filing up to 180 days before expiration, but applicants should confirm the window applicable to their specific eligibility code.

Do renewal applications still receive an automatic 540-day extension?

Not generally. The broad extension ended for renewal applications filed on or after October 30, 2025. Earlier filings and category-specific rules may be treated differently.

Does STEM OPT provide an automatic extension?

A timely filed and eligible STEM OPT extension application may extend employment authorization for up to 180 days while the case is pending.

Can I continue working with only the Form I-765 receipt?

Only when a specific law, regulation or government notice authorizes continued employment. A receipt notice alone does not create work authorization.

Can D4U determine whether I am legally authorized to continue working?

D4U can help organize the timeline and documents, but a licensed immigration professional should evaluate legal eligibility when the category or extension rule is uncertain.
